Unnao rape: Allahabad High Court raps Adityanath govt, says will monitor probe

The Allahabad High Court on Friday directed the Central Bureau of Investigation to arrest Kuldip Singh Sengar, the BJP lawmaker who has been walking free for a week after being publicly accused by a minor of having gang-raped her.

The alleged accused in the case MLA Senger has not been arrested yet.

Through his letter, Chaturvedi requested the court to take suo motu cognizance of the incident in which a girl was allegedly raped by the MLA and his aides. "The SIT formed by the state police will continue its investigation and collect evidence in the case", the DGP said, vehemently denying that the government was trying to protect the MLA.

An FIR was lodged against Sengar under Sections 363 (punishment for kidnapping), 366 (abducting and inducing a girl), 376 (punishment for rape) and 506 (criminal intimidation) of the Indian Penal Code.

Advocate General Raghavendra Singh, who was present in the court on its direction, informed the bench that on August 17, 2017, an application was sent to the Chief Minister's Office in which allegations of rape was made against the lawmaker.

Yesterday, the court had asked the Advocate General whether the state government proposes to arrest Sengar.

The court, completing the hearing, reserved its judgement for Friday at 1400 hours. It directed CBI to carry out the investigations strictly in accordance with law and file a status report by May 2.

Sengar had been moving around freely, denying the accusations, making disparaging comments about the girl and her family and hitting out at the media in the Unnao rape case.

Sengar, on Wednesday night, asked the Lucknow police to call him if there was an arrest warrant against him. Sengar maintained that he was being framed and told the police, "When there is an arrest warrant, call me". "I have come here because TV channels were saying I will surrender", he appeared to taunt reporters, insisting that he was neither a fugitive nor a rapist. The bench said the father of prosecutrix was "beaten up by the brother and the goons of Kuldeep Singh and was arrested and in the custody was beaten mercilessly".

An FIR was registered against Sengar in Makhi police station on Thursday.

On Thursday, police lodged an FIR against Sengar in connection with the alleged gangrape after the UP government chose to hand over the probe to the CBI. The bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud said it would hear the plea which has also alleged that the rape victim's father was tortured and killed in the police custody at the behest of the "ruling party" in the state. Since the murder charge was added later by the police, it does not reflect in the central probe agency's FIR.

After filing of the case, the victim's father was booked by the police under the arms act on April 3 this year and was put in jail two days later.
